This Privacy Statement is based on the Landsverordening Bescherming Persoonsgegevens (‘LBP’) and wherever required on the General Data Protection Regulation (‘GDPR’) and provides compliance of E-sites Caribbean B.V. (hereinafter referred to as ‘E-sites Caribbean’) with these data protection laws. It sets out the data protection practices carried out using the Internet and any other electronic communications networks by E-sites Caribbean.

1. Personal Information Collected

E-sites Caribbean collects personal data of users:

  • through registration forms;
  • when you send us an employment application;
  • every time you sign up for an electronic newsletter;
  • when you register for an event;
  • when you submit a request for proposal or for information;
  • when you request the authorization of downloading a document
  • when you enter an online competition; and/or
  • when you send us a message via an email reply mechanism provided on the E-sites Caribbean websites.

2. Lawful reasons for processing personal data

E-sites Caribbean may rely on the following lawful reasons when we collect and use personal data to operate our business and provide our products and services: 

  • Contract - We may process personal data in order to perform our contractual obligations.
  • Consent - We may rely on your freely given consent at the time you provided your personal data to us. 
  • Legitimate interests - We may rely on legitimate interests based on our evaluation that the processing is fair, reasonable and balanced. These include:
    • Delivering services to our clients – To deliver the professional services our clients have engaged us to provide.
    • Direct marketing – To deliver timely market insights and speciality knowledge we believe is welcomed by our business clients, subscribers and individuals who have interacted with us. 
  • Legal obligations and public interests – We may process personal data in order to meet regulatory and public interest obligations or mandates. 

3. Use of Personal data

E-sites Caribbean processes personal data collected via the E-sites Caribbean websites for the purposes of:

  • providing our services that you request from us;
  • contacting you about your enquiries and requests;
  • recruitment;
  • proposing/inviting to participate in E-sites Caribbean’s online communities;
  • proposing/inviting to informational events and conferences;
  • providing you with information about products and services;
  • delivering customized content that may be of interest to you;
  • statistical and marketing analyses of our users’ needs and preferences to improve customer experience; and/or
  • monitoring for security purposes, to detect and prevent cyberattacks.

4. Retention period of Personal data

4.1     E-sites Caribbean retains personal data to provide services, stay in contact users and to comply with applicable laws, regulations and professional obligations that E-sites Caribbean is subject to.

4.2     E-sites Caribbean retains personal data for seven years. Unless a different time frame applies because of business need or specific legal, regulatory or contractual requirements in such a case E-sites Caribbean will retain personal data in accordance with these uses.

4.3     E-sites Caribbean will dispose of personal data in a secure manner when we no longer need it.

5. Data we Gather automatically and how we use it

5.1     When you visit one of the E-sites Caribbean websites, we collect data automatically about those visits.

5.2     In particular, your browser automatically sends us certain internet-related data, such as the Internet Protocol (IP) address of the computer you are using.

5.3     We also collect data using cookies to better understand how visitors use the E-sites Caribbean websites, to identify problems with our servers, prepare aggregate demographic information and other information regarding the use of the E-sites Caribbean websites, and to improve the functions of the E-sites Caribbean websites. 7. Data We Share

We will only disclose personal data to other companies within our group of companies, business partners, government bodies and law enforcement agencies, successors in title to our business and suppliers we engage to process data on our behalf. In these circumstances we will share your personal data for purposes such as our legitimate business purposes and to comply with legal obligations.

8. Links to Other Sites

8.1     This Privacy Statement applies only to data collected by a E-sites Caribbean website.

8.2     E-sites Caribbean websites contain links to other websites that are not owned or administered by E-sites Caribbean. Please be aware that E-sites Caribbean is not responsible for the privacy practices of such other third-party websites. We encourage you to read the privacy statements of every website you visit.

9. Security

9.1     E-sites Caribbean has put appropriate technical and organisational security policies and procedures in place to protect personal data (including sensitive personal data) from unauthorised disclosure, loss, misuse, alteration or destruction.

9.2     E-sites Caribbean aims to ensure that access to your personal data is limited only to those who need to access it. Those individuals who have access to the data are required to maintain the confidentiality of such information.

9.3     E-sites Caribbean may apply pseudonymisation, de-identification and anonymisation techniques in efforts to further protect personal data.

9.4     If you have access to parts of the E-sites Caribbean websites or use E-sites Caribbean services, you remain responsible for keeping your user ID and password confidential.

9.5     Please be aware that the transmission of data via the Internet is not completely secure. Whilst we do our best to try to protect the security of your personal data, we cannot ensure or guarantee the security of your data transmitted to our site; any transmission is at your own risk.

10.1     E-sites Caribbean wants to make sure that any data we hold on you is up to date and correct. You can request information about:

10.2     Furthermore, and within applicable the legal framework, you have the right to:

  • request for your personal data to be amended or rectified where it is inaccurate;

11. International Transfers

Given that the internet is a global environment, using the internet to collect and process personal data necessarily involves the transmission of data on an international basis. We may transfer personal data to E-sites Caribbean servers situated outside Curaçao and to reputable third-party organizations situated inside or outside Curaçao, when we have a business reason to engage these organizations. Each organization is required to safeguard personal data in accordance with our contractual obligations and data protection legislation.

12. Changes to the Privacy Statement

We reserve the right to amend this Privacy Statement at any time without advance notice in order to address future developments of E-sites Caribbean, the website or changes in industry or legal trends/standards. We will post the revised Statement on the E-sites Caribbean websites or announce the change on the home page of the E-sites Caribbean websites.
You can determine when the Privacy Statement was revised by referring to the "Last Updated" date on the top of this Statement. Any changes will become effective upon the posting of the revised Privacy Statement on the E-sites Caribbean websites. If you do not agree with the terms of this Privacy Statement, in whole or part, you can choose to not use the E-sites Caribbean websites.
